The so-called snap-back mechanism lacks a legal basis and in case it is used against Iran by the European Troika, then it will be faced with a due response.

Why it matters: 

The implementation of snapback against Iran will put further pressure on the Iranian nation due to the more sanctions the West imposes. The sanctions will be imposed on Iran despite its commitment to the internationally signed nuclear deal of Iran in 2015, known as the Joint Comprehensive Plan of Action (JCPOA).

Esmail Baghaei: "Resorting to such a baseless mechanism—devoid of any legal, ethical, or political foundation—is merely an instrumentalization of a provision that was included in Resolution 2231 and the JCPOA for specific reasons, and it has no justification."

"Iran still considers itself a member of the JCPOA and has reduced its commitments in response to the actions of the other parties. These measures were in accordance with the text of the JCPOA."

"The European parties themselves committed serious and fundamental violations of their obligations under the JCPOA and failed to fulfill their responsibilities. Therefore, they have no legal or moral standing to invoke this mechanism."

 

Flashback:

  • JCPOA was signed in 2015 between Iran of 5+1 countries (U.S., U.K., France, China, Russia, Germany) to lift some sanctions on Iran instead of Iran's limitations on some aspects of its nuclear program.
     
  • In May 2018, the U.S. unilaterally withdrew from the JCPOA. Following the U.S., the European part withdrew, as Iran fulfilled its commitment to the international agreement.
     
  • Given that, the Islamic Republic decided to scale back its commitments after the parliament approved the 'Strategic Action to Lift Sanctions' to scale back from some of its commitments under the very JCPOA.
